1. Introduction

These Terms of Service ("Terms") govern your use of Erudia ("the Service," "the Platform"), operated by Christian Persson, sole proprietor, based in Blonay, Switzerland ("we," "us," "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Description of Service

Erudia is an AI-powered learning platform that generates personalized educational courses based on topics you provide. The Service includes AI-generated content such as course materials, podcast audio, flashcards, quizzes, and assignments.

3. Account Registration

To use the Service, you must:

  • Create an account with a valid email address
  • Be at least 16 years of age
  • Provide accurate and complete information
  • Keep your login credentials secure

You are responsible for all activity under your account. Notify us immediately at support@erudia.io if you suspect unauthorized access.

4. Pricing and Payment

4.1 Plans

We offer the following plans:

  • Single Course: $9 USD — one-time purchase for one course
  • Monthly Subscription: $20 USD/month — up to 5 courses per month
  • Annual Subscription: $169 USD/year — up to 5 courses per month

Prices are in US Dollars and may be subject to applicable taxes (e.g., VAT) depending on your location. We will display the total amount including any applicable taxes before you complete your purchase.

4.2 Payment Processing

Payments are processed by Stripe, Inc. By making a purchase, you also agree to Stripe's terms of service. We do not store your credit card information.

4.3 Subscriptions

  • Subscriptions renew automatically at the end of each billing period (monthly or annually) unless cancelled.
  • You can cancel your subscription at any time through the billing portal accessible in your account settings.
  • Upon cancellation, you retain access until the end of the current billing period.
  • The monthly course generation limit (5 courses) resets at the beginning of each billing cycle. Unused courses do not roll over.

4.4 Promotional Codes

We may issue promotional codes granting free access to courses. Promotional codes are subject to their specific terms, are non-transferable, may not be combined with other offers, and may expire.

4.5 Price Changes

We may change our pricing at any time. For active subscribers, price changes take effect at the start of the next billing period. We will notify you at least 30 days in advance of any price increase.

4.6 Learning Guarantee

We offer a 30-Day Learning Guarantee on all course purchases. If you are not satisfied with your course for any reason, you may request a full refund within 30 days of purchase by contacting support@erudia.io. This guarantee is in addition to your statutory rights under EU consumer protection law.

5. Right of Withdrawal (EU Consumers)

If you are a consumer residing in the European Union, you have the right to withdraw from your purchase within 14 days of the date of purchase, without giving any reason, in accordance with the EU Consumer Rights Directive (2011/83/EU).

5.1 How to Withdraw

To exercise your right of withdrawal, notify us at support@erudia.io with a clear statement of your decision (for example: "I wish to withdraw from my purchase"). You may also use the standard withdrawal form provided by the European Commission, though this is not mandatory.

5.2 Effects of Withdrawal

Upon valid withdrawal, we will reimburse all payments received from you, without undue delay and in any event within 14 days. We will use the same payment method you used for the original transaction.

5.3 Exception for Digital Content

If you have expressly consented to begin using the Service (e.g., generating a course) before the 14-day withdrawal period has expired, and you acknowledge that you thereby lose your right of withdrawal for that specific purchase, the right of withdrawal does not apply to courses already generated at your request. This is in accordance with Article 16(m) of the Consumer Rights Directive.

At checkout, you will be asked to acknowledge: "I agree that course generation begins immediately and I understand that I lose my right of withdrawal once my course has been generated."

5.4 Subscriptions

For subscriptions, the 14-day withdrawal period begins on the date the subscription contract is concluded. If you have used the Service during this period, any refund may be proportionally reduced for the services already provided.

6. AI-Generated Content

6.1 Nature of Content

All course materials, podcast scripts, audio, flashcards, quizzes, and assignments are generated by artificial intelligence. While we strive for accuracy and quality:

  • AI content may contain errors. We do not guarantee the accuracy, completeness, or reliability of AI-generated content. You should verify important information independently.
  • Content is for educational purposes only. It does not constitute professional, medical, legal, financial, or other specialized advice.
  • Content is generated, not curated. Unlike traditional courses created by human instructors, our content is computationally generated based on publicly available information and AI models.

6.2 Content Ownership

  • Courses generated for you are available for your personal educational use.
  • You may not resell, redistribute, or commercially exploit AI-generated course content without our prior written consent.
  • We retain the right to use aggregated, anonymized usage patterns to improve the Service (not your specific inputs or generated content).

6.3 No Certification

Courses completed on Erudia do not confer academic credits, professional certifications, or legally recognized qualifications.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to generate content that is hateful, violent, sexually explicit, or otherwise harmful
  • Circumvent usage limits, payment requirements, or security measures
  • Share your account credentials with others
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use automated tools to scrape or extract content from the platform
  • Overwhelm the Service with excessive requests designed to degrade performance

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Intellectual Property

  • The Erudia platform, its design, features, and underlying technology are owned by us and protected by applicable intellectual property laws.
  • Your course inputs (topics, preferences) remain yours.
  • AI-generated course content is provided to you under a personal, non-exclusive, non-transferable license for educational use.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
  • We are not responsible for the accuracy of AI-generated content or for any decisions you make based on such content.

These limitations do not affect your statutory rights as a consumer under applicable EU or Swiss law, which cannot be excluded or limited by contract.

10. Availability and Modifications

  • We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience technical difficulties.
  • We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For material changes affecting your subscription, we will provide reasonable advance notice.

11. Termination

11.1 By You

You may terminate your account at any time by contacting support@erudia.io or using the account deletion feature in your settings. Termination does not entitle you to a refund for any unused portion of a subscription, except as required by applicable law (see Section 5).

11.2 By Us

We may suspend or terminate your account if you breach these Terms, with reasonable notice where possible. In cases of serious violation, we may terminate immediately.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Switzerland, without regard to its conflict of laws provisions.

12.2 Jurisdiction

Any disputes arising from these Terms shall be submitted to the competent courts in Lausanne, Switzerland.

12.3 EU Consumers

If you are a consumer in the EU, you may also bring proceedings in the courts of the EU member state in which you reside. Additionally, you have the right to submit complaints to the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Nothing in these Terms affects your statutory rights as a consumer.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a notice on the platform at least 30 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance.

14. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
